OP posted seeking advice on what she should do after her neighbor sued her for $235,000 for helping walk her child from the bus stop to the house. The neighbor claims that she hasn’t been able to get a job.
Pay For My Unsolicited Labor
OP’s(original poster) house is located across the street from where the bus drops all the neighborhood kids. Her house is on the dead end of the neighborhood, 40 ft from where the bus takes a turn.
OP says everything is on camera, including how the kids are dropped off and how the bus makes a turn. Besides, the bus takes a shorter period to turn, therefore, not posing any risk to the children crossing the road.
OP has checked the footage and says her child is never on the road at the same time as the bus.
Civil Papers
Now, OP has received civil court papers, and the neighbor is claiming $159,925 for five years of lost wages. The affidavit states that the neighbor could not get another job because there would be nobody else to protect OP’s son.
She says there needs to be someone to protect the child from being run over by the bus.
Emotional Distress
But that is not all, she demands another $75,000 for the emotional distress OP has caused her and her family. Apparently, she needs to be compensated for the trauma being inflicted every day by OP’s son almost getting run over by the bus.
OP finds it a little questionable because the school has never called her concerning the bus almost running over her son daily. OP has also waited for her son at the bus stop, and the driver has never mentioned such a thing.
Maybe a Little Background
OP says she has never asked her neighbor to occupy herself with caring for her son after the drop-offs.
She adds that eight kids get off at this same drop-off, and there is usually no parent waiting to pick them up; they all walk to their houses.
Mental Issues
While this may be irrelevant to this case, OP says her neighbor likely has mental issues. For instance, her kids are prohibited from walking on grass because they might have been sprayed with chemicals.
Besides, a year before, OP had a fire in her yard, and the neighbor yelled over the fence, saying the ground was dry and they would burn the whole neighborhood down. She also knocked on OP’s door and asked them to bring their trampoline down because trampolines are dangerous.
Paranoid
She will also not use lawnmowers or snowblowers because they are dangerous.
It may be a case of being too paranoid, but OP thinks it says something about her getting sued.
What should OP do? Should she talk her down to withdraw the case? Or should she get her lawyer to respond?
Take Their Stand
“This person is claiming that she took it upon herself to supervise your kid getting off the bus, and therefore she couldn’t work, and you owe her lost wages? That is preposterous. If you were served with an actual lawsuit, you need an attorney to respond. But don’t lose sleep over this. It won’t be expensive to get dismissed,” One commenter said.
Get a Lawyer
Another added, “Don’t stress it but don’t ignore it. Get a lawyer, and it’s likely to be easily dismissed. Do not try to talk to her. Speak to your lawyer only, and follow their lead. Also, make sure your son knows not to engage with her. She seems mentally unwell and potentially dangerous. Her obsession with him is concerning. If you aren’t already, document every incident with her – especially those involving your son.”
And lastly, “Get an attorney. Not only will this be dismissed quickly, but your attorney fees may be recoverable in a counterclaim as the bad faith she’s acting under may rise to abuse of process. Civil court judges enjoy making people find out after they f**** around attempting to weaponize the legal system.”
